GreatDay (operated by Ailuna GmbH)

This End User License Agreement (“Agreement”) governs the use of the GreatDay platform, including the website, software applications, and related services (collectively the “Service”).

The Service is provided by:

(“Ailuna”, “we”, “us”, “our”).

By accessing, downloading, installing, or using the Service, you agree to be bound by this Agreement.

If you do not agree to these terms, you must not use the Service.

1. Description of the Service

GreatDay is a digital platform designed to support daily engagement, communication, and wellbeing, including interactive features such as avatars, reminders, communication tools, and other supportive digital services.

The Service is intended to support users in everyday life but does not replace professional medical, psychological, or caregiving services.

GreatDay does not provide medical advice, diagnosis, or treatment.

2. License Grant

Subject to compliance with this Agreement, Ailuna grants you a limited, non-exclusive, non-transferable, revocable license to access and use the GreatDay Service for its intended purpose.

This license does not allow you to:

  • copy, modify, or distribute the software
  • reverse engineer, decompile, or attempt to extract the source code
  • sell, sublicense, or commercially exploit the Service without written permission
  • use the Service for unlawful purposes.

All rights not expressly granted remain with Ailuna.

3. User Accounts

To use certain features, you may be required to create a user account.

You agree to:

  • provide accurate and complete information
  • keep login credentials confidential
  • immediately notify us of unauthorized use of your account.

You are responsible for all activities conducted through your account.

4. Acceptable Use

Users agree not to:

  • use the Service for illegal or harmful purposes
  • upload or distribute harmful software or viruses
  • harass, abuse, or harm other users
  • impersonate another person or entity
  • interfere with the operation or security of the Service.

Ailuna reserves the right to suspend or terminate access if these rules are violated.

5. Data Protection and Privacy

The processing of personal data is governed by our Privacy Policy and complies with the General Data Protection Regulation (GDPR / DSGVO).

By using the Service, you consent to the processing of personal data necessary for:

  • operating the platform
  • providing features and services
  • improving system performance and user experience.

6. Intellectual Property

All intellectual property rights related to the Service, including but not limited to:

  • software
  • design
  • trademarks
  • logos
  • content

are the exclusive property of Ailuna GmbH or its licensors.

Unauthorized use is prohibited.

7. Updates and Changes

Ailuna may update or modify the Service and this Agreement from time to time.

Users will be informed of material changes where required by law.

Continued use of the Service after changes become effective constitutes acceptance of the updated terms.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the extent permitted by law, Ailuna does not guarantee that:

  • the Service will be uninterrupted or error-free
  • defects will be corrected
  • the Service will meet all user expectations.

9. Limitation of Liability

To the extent permitted under Austrian law:

Ailuna shall only be liable for damages caused by intent or gross negligence.

Liability for slight negligence is excluded, except in cases of:

  • personal injury
  • mandatory liability under applicable law.

Ailuna shall not be liable for:

  • indirect or consequential damages
  • loss of profits
  • loss of data
  • damages caused by misuse of the Service.

10. Availability of the Service

Ailuna strives to ensure high availability but does not guarantee uninterrupted access.

Maintenance, updates, or technical issues may temporarily affect availability.

11. Termination

Ailuna may suspend or terminate access to the Service if:

  • the user violates this Agreement
  • the Service is discontinued
  • legal or security reasons require such action.

Upon termination, the license granted under this Agreement ends immediately.

12. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Austria, excluding conflict-of-law rules.

For business users, the competent court in Vienna, Austria shall have exclusive jurisdiction.

For consumers, mandatory consumer protection laws and jurisdiction rules apply.

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
