2. Scope of Application
These Terms and Conditions (“Terms”) apply to the use of the GreatDay platform, mobile apps and related digital services (“Services”) provided by Ailuna GmbH to consumers.
By registering, accessing or using the Services, you agree to these Terms.
3. Description of Services
GreatDay provides access to a digital AI avatar assistant that supports users with personal organisation, planning and self-management.
The Service is provided through a web browser and native iOS/Android apps.
Ailuna GmbH may enhance, expand, or adjust functionalities or discontinue specific features, provided this does not materially affect the core functionality for existing users.
4. User Requirements and Obligations
- Users must be 18 years or older.
- Users must provide accurate and current registration and payment information.
- Login credentials must be kept confidential and may not be shared.
- Misuse of the Services or use for unlawful purposes is prohibited.
5. Fees and Subscription Model
The Services are offered on a paid subscription basis. The current pricing and available plans are displayed at:

- Subscriptions renew automatically unless cancelled.
- Billing cycles are monthly or yearly. Annual plans include a discounted rate.
- Promotional free trial periods may apply at Ailuna GmbH’s discretion.
- All prices include applicable VAT.
6. Payment and Renewal
- Subscriptions are billed in advance at the start of each billing cycle.
- By completing registration, entering valid payment details, and pressing “Subscribe”, a binding paid contract is formed.
- Unless cancelled before the renewal date, subscriptions renew for the same period.
- If payment cannot be processed successfully, access may be suspended until payment is completed.
7. Cancellation
Users may cancel their subscription at any time through their account settings within GreatDay.
A cancellation becomes effective at the end of the current paid billing period.
If a user cannot cancel via the account interface due to a technical issue, they may contact office@ailuna.care for assistance.
There is no pro-rata refund for unused time within a billing period unless required by law.
8. No Right of Withdrawal for Digital Services (Article 16 EU Consumer Rights Directive / § 18 FAGG)
This service is a digital service (SaaS) that is made available to the user immediately after conclusion of the contract.
Therefore, no statutory withdrawal right applies once the user starts using the service.
By creating an account, providing payment details and accessing the software, the consumer expressly:
- requests that Ailuna GmbH begins providing the digital service immediately, and
- acknowledges that the statutory right of withdrawal is lost as soon as the service provision begins.
For this reason, withdrawal from the contract is excluded once the service usage begins.
9. Technical Requirements
Users require:
- A desktop/laptop computer with a modern web browser,
or - An iOS or Android smartphone with the GreatDay app
- A stable internet connection
Ailuna GmbH is not responsible for service issues caused by the user’s equipment, device settings, or internet provider.
10. Intellectual Property
All content, software and materials provided within the Services remain the property of Ailuna GmbH or its licensors.
Users receive a personal, non-exclusive, non-transferable right to use the Services for private purposes only.
11. Liability and Warranty
Ailuna GmbH endeavours to provide reliable and high-availability access but cannot guarantee uninterrupted or error-free operation.
- Liability for slight negligence is excluded, except in cases of personal injury.
- Liability for gross negligence or intent remains unaffected.
- Liability for indirect or consequential loss, lost profits or data loss is excluded to the extent legally permitted.
- Statutory consumer rights, including warranty rules and mandatory updates for digital content, remain unaffected.
12. Termination by Ailuna GmbH
Ailuna GmbH may suspend or terminate access if a user:
- violates these Terms,
- misuses or disrupts the Services, or
- fails to make due payments.
Unless legally justified earlier, access ends at the end of the paid period.
13. Contract Duration
The contract runs for the selected subscription term (monthly or yearly) and renews automatically unless cancelled.
There is no minimum commitment beyond the selected billing cycle.
14. Data Protection
Personal data is processed in line with our Privacy Policy, available at: https://greatday.my/privacy-policy/
Ailuna GmbH complies with the GDPR.
15. Amendments to these Terms
Ailuna GmbH may update or modify these Terms if required for legal, operational, or security reasons.
Users will be informed at least 30 days in advance, typically by email or in-app notification.
Users may cancel before the effective date of the changes.
16. Governing Law and Jurisdiction
These Terms are governed by Austrian law.
For consumers, mandatory provisions of their country of residence and statutory jurisdiction rules apply.
For business users, the exclusive place of jurisdiction is Vienna, Austria.
17. Online Dispute Resolution
The European Commission’s ODR platform is available at:
https://ec.europa.eu/consumers/odr/
Ailuna GmbH is not obligated to participate in consumer arbitration processes but may do so voluntarily.
18. Severability
If any section of these Terms becomes invalid, the remaining provisions remain effective.
